Limited Use Label License 

This product and/or its derivatives are subject to one or more U.S. and foreign Patents (e.g., U.S. Pat. No. 9,370,200; a full list is available https://www.prairieaquatech.com/patents/). By accepting/opening this product, you agree to comply with the terms of this Limited Use Label License. The product is provided to you for research/evaluation use only. You may not reverse engineer this product. Further, you may not transfer or otherwise sell this product or its derivatives to a third party without the express written permission of Prairie Aquatech LLC. No rights are given to you to use the product or its derivatives for commercial use or purposes as defined below. 

“Commercial Use” shall mean, but not be limited to: (a) providing a service, information, or data to a person or entity not party to this Agreement for financial gain; (b) production or manufacture of products for general sale or products for use in the manufacture of products ultimately intended for general sale; (c) use in the development of products for sale to third parties; (d) use of the product for therapeutic, diagnostic, or prophylactic purposes; or (e) use in connection with proficiency testing service(s), including but not limited to, calibrations or tests on the same or similar items or materials in accordance with predetermined conditions. 

If you wish to obtain more product going forward, a Material Transfer Agreement must be executed. 

Product use must comply with all laws and regulations, including but not limited to current EPA, FDA, and USDA guidelines. 

MATERIALS MAY NOT BE USED IN HUMANS. 

You acknowledge that the product is provided WITHOUT WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER WARRANTY, EXPRESS OR IMPLIED. PRAIRIE AQUATECH LLC. MAKES NO REPRESENTATION OR WARRANTY THAT THE USE OF THE PRODUCT WILL NOT INFRINGE ANY PATENT OR OTHER PROPRIETARY RIGHTS. 

In no event shall Prairie Aquatech be liable for any use of the product by you. You agree to defend, indemnify, and hold harmless Prairie Aquatech LLC, its officers, employees, and agents from any loss, claim, injury, damage, expense, or liability (including attorney’s fees), of whatsoever kind or nature, which may arise from or in connection with this Agreement, including but not limited to purchases, use, handling, or storage of the product.
